Terms of Service

The Service

Nightwatch is a military-intelligence platform that aggregates public sources, satellite imagery and AI-generated analysis of the Russo-Ukrainian conflict. Functionality is provided through web dashboards and REST APIs.

Eligibility

You must be at least 16 years old and legally able to form a binding contract. Where law prohibits receiving military/intelligence data you must not use Nightwatch.

Accounts & Authentication

Sign-in is via OAuth (Google, Twitter, GitHub). You are responsible for maintaining the security of your OAuth credentials and restricting access to your devices. Notify us immediately of any unauthorised use.

Subscription Plans

All paid plans include a 7-day free trial. Payment is handled by Stripe and recurs monthly until cancelled. Prices include VAT where applicable.

Billing, Cancellations & Refunds

You may cancel anytime from your dashboard; access continues until the end of the current billing cycle. We honour any mandatory cooling-off period (e.g., EU 14-day digital-content rules) and otherwise provide refunds only where required by law or at our sole discretion.

Rate Limits & Fair Use

Each tier's call quota resets monthly. Excess usage may be throttled or suspended without notice. Automated scraping, sharing credentials or attempting to bypass limits violates these Terms.

Acceptable Use

You agree NOT to:

• violate export-control, sanctions or defence-trade laws;
• use the Service to target civilians or facilitate war crimes;
• reverse-engineer, decompile or copy the Service or its datasets;
• resell, sublicense or publicly display Free-tier watermarked exports;
• overload or interfere with our networks.

Intellectual Property

We own all software, design and compilation rights. Source texts and satellite images remain subject to their original licences (e.g., ESA Copernicus). You receive a non-exclusive, revocable licence to use generated content internally. All trademarks are property of their respective owners.

Data Accuracy & Disclaimers

Third-Party Services

Nightwatch integrates with Stripe, OpenAI, Copernicus, Currents API and OAuth providers. We are not responsible for interruptions or data loss caused by these vendors.

Export Controls

Termination

We may suspend or terminate your account at any time for breach of these Terms or to comply with law. Upon termination your licence ends and your right to access the Service ceases.

Limitation of Liability

To the maximum extent permitted by law, Nightwatch and its owner will not be liable for indirect, incidental, special or consequential damages, loss of profits, loss of data, or personal injury arising out of or related to the Service, even if advised of the possibility. Our aggregate liability is limited to the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to defend and indemnify us against any claims arising from your use of the Service, your breach of these Terms or violation of any law.

Governing Law & Dispute Resolution

These Terms are governed by Finnish law, excluding conflict-of-law rules. Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the District Court of Helsinki, Finland, unless mandatory consumer-protection law provides otherwise.

Changes to Terms

We may modify these Terms. Material changes will be announced by email or in-app at least 14 days before taking effect. Continued use constitutes acceptance.
